The major objectives in these two conferences are to enhance the continuing education of a range of specialties in medicine and allied professions, including obstetrics, gynecology, midwifery, neonatology, medicine, surgery, family medicine, emergency medicine, cardiology, radiology, human genetics, and ethics. No. Carolina Forced Sterilizations Update: $10 Million for Surviving Victims of Eugenics Program

North Carolina will spend $10 million to compensate men and women who were sterilized in the state's eugenics program, which was among the most extensive and long-running of its kind.

North Carolina sterilized 7,600 people from 1929 to 1974 who were deemed socially or mentally unfit. Victims were as young as 10 years old and nearly all were sterilized forcibly or with inadequate consent, according to the state.

A. Background:

Eugenics (sexual sterilizations) started in North Carolina in 1929 with the passage of the sterilization law and continued through 1973, when the last recorded sterilizations were known to be reported.

B. Number of Victims:
 
Over 8,000 sterilizations were approved by the Eugenics Board of North Carolina. The total number of victims actually sterilized is estimated to have been over 7,600 (Winston-Salem, “Lifting the Curtain on a Shameful Era”).  Of this number, females represented approx. 85% of those sterilized (State Library, “Statistics,” p. 1).  By the late 1960s, the sterilization of men was virtually halted, as women made up 99% of those sterilized (Sinderbrand, p. 1).  African Americans represent 39% of those sterilized overall; by the later 1960s, they made up 60% of those sterilized, even though they made up only a quarter of the population (Sinderbrand, p. 1).  Of those sterilized up to 1963, 25% were considered mentally ill and 70% were considered mentally deficient.  In each of these categories, females account for over 75% of the sterilizations.  North Carolina ranked third in the United States for the total number of people sterilized.
 
 
C.  The Legislature this past week approved a $10 million compensation fund that would begin paying out in June 2015. So far the state has identified 177 living victims. The amount of compensation each receives will depend on the number of verified claims, according to the state Department of Administration. If 200 people are verified, for example, each would receive $50,000.
 
"The money don't take up the place of what happened," said Willis Lynch, an 80-year-old retired handyman who was sterilized at age 14 after being deemed mentally unfit. "I'm glad they did something, though."

Mr. Lynch said he was sent to a school for the mentally and developmentally disabled after his widowed mother could no longer care for her seven children. Records from the state's eugenics board show that in the late 1940s no one from that school was to leave without being sterilized, except in cases where children had been committed in error.
 
Former Rep. Larry Womble says North Carolina will be the first state to compensate people who had been forcibly sterilized. "They had not done anything wrong, they were just born poor, and this was a way of social engineering," said Mr. Womble, a Democrat who began proposing compensation more than a decade ago. "Who knew that right here in the United States we tried to do something like that?"

Mr. Womble began introducing proposals to compensate the victims after the Winston-Salem Journal published a 2002 series on the then little-remembered program. Former Gov. Mike Easley apologized to eugenics victims in 2002, but the Legislature has up until now been unable to settle on how best to compensate victims.

While 30 states had eugenics programs in the early 20th century, North Carolina was one of the few that accelerated its program after a backlash against the eugenics practices of Nazi Germany. Mr. Stam says that nearly 80% of the state's sterilizations took place after 1945.

In the program's early days, the people who were sterilized were in proportion to the state's racial mix, Mr. Stam said. But in the 1960s, the program began to sterilize black people at a disproportionate rate of 60% even though blacks only represented about 25% of the state population. Eighty-five percent of those sterilized over the lifetime of the program were women.

About 2,000 of the 7,600 who were sterilized were under age 18, he said. Compensation for sterilization victims was a rare issue with bipartisan support in the state's six-month legislative session that wrapped up Friday.

For Elaine Riddick, who was sterilized as part of the program as a young girl, the compensation will be the culmination of a long-fought effort. She was vocal in the bid to get compensation. The Supreme Court of the United States (SCOTUS), in a 5 to 4 vote, decided and ruled on Monday, June 3rd, 2013, in this controversial Maryland case that:

When officers make an arrest supported by probable cause to hold for a serious offense and bring the suspect to the station to be detained in custody, taking and analyzing a cheek swab of the arrestee's DNA is, like fingerprinting and photographing, a legitimate police booking procedure that is reasonable under the Fourth Amendment. 

BACKGROUND 

After his 2009 arrest on first- and second-degree assault charges, respondent King was processed through a Wicomico County, Maryland, facility, where booking personnel used a cheek swab to take a DNA sample pursuant to the Maryland DNA Collection Act (Act). The swab was matched to an unsolved 2003 rape, and King was charged with that crime. He moved to suppress the DNA match, arguing that the Act violated the Fourth Amendment, but the Circuit Court Judge found the law constitutional. King was convicted of rape. The Maryland Court of Appeals set aside the conviction, finding unconstitutional the portions of the Act authorizing DNA collection from felony arrestees.
 
SUMMARY SCOTUS DECISION
 
The police may take DNA samples from people arrested in connection with serious crimes.
 
Maryland and 27 other states, as well as the federal government currently authorize this DNA sampling practice.  All 50 states require the collection of DNA from felony convicts.  Law enforcement officials claim it is a valuable tool for investigating unsolved crimes.  But the Court in its 5 to 4 decision said the testing was justified by a different reason: to identify the suspect in custody.

Justice Antonin Scalia summarized his dissent from the bench, a rare move signaling deep disagreement. He accused the majority of an unsuccessful sleight of hand, one that “taxes the credulity of the credulous.” The point of DNA testing as it is actually practiced, he said, is to solve cold cases, not to identify the suspect in custody.
 
But the Fourth Amendment forbids searches without reasonable suspicion to gather evidence about an unrelated crime, he said, a point the majority did not dispute. “Make no mistake about it: because of today’s decision, your DNA can be taken and entered into a national database if you are ever arrested, rightly or wrongly, and for whatever reason,” Justice Scalia said from the bench.

DIVIDING & SPLITTING LOTTERY WINNINGS: DIVIDING & SPLITTING LOTTERY WINNING DURING DISSOLUTION OF MARRIAGE

With the growing popularity of Powerball and state lotteries, along with the growing number of casinos and prize money games, courts are being forced to deal with prize money in dividing property during marital dissolution proceedings.

The law is well settled that a lottery prize won during a marriage is generally considered property acquired during the marriage subject to equitable distribution. However, community property and marital property states differ in the theories adopted, and even some marital property states differ in considering whether "equitable" means an equal distribution in dividing lottery winnings during a divorce.

Courts that have already dealt with this issue have focused on a number of factors in determining how to divide the property.
 
States property schemes generally fall into one of two categories, common law or community property. Common law states differentiate their property scheme from community property states by the way property is titled during the marriage.  

Generally, in common law states, title controls ownership of the property during the marriage. At divorce, common law states presume property is “marital” property, unless it falls under one of the exceptions that generally relate to the source of acquisition, such as a gift, bequest or inheritance or the timing of acquisition as before the marriage. 

Common law property states divide property based on an equitable, but not always equal distribution.

In equitable distribution states, “marital property” resembles community property.  

An equitable division is the division of marital property by a court in a divorce proceeding under statutory guidelines that provide for a fair, but not necessarily equal, allocation of the property between the spouses.  

Depending on the relevant state statutes, courts can take into account a variety of factors in determining a fair and just division of property in a divorce action including the disparity of earning power of the parties, their business opportunities, capacities and abilities, the physical condition of the parties and probable future need for support and educational background, the fault in breaking up the marriage, and the benefits the innocent spouse would have received from continuation of the marriage.   

Equitable distribution is applied in nearly all the states that do not have a community property system.  Community property states view married couples as each having a one-half divided interest in property accumulated during the marriage, regardless of title.

Upon divorce, courts in these states divide property that has accumulated during the marriage, but also exclude property acquired through individual gift or inheritance.   

Like the equitable distribution theory adopted by common law states, six of the nine community property states also use the equitable division rule. The states having community property are Louisiana, Arizona, California, Texas, Washington, Idaho, Nevada, New Mexico, and Wisconsin. 

MARYLAND versus ARIZONA 

In an Arizona divorce case, Lynch v. Lynch, the wife sought a share of lottery proceeds from a lottery ticket purchased by her husband. The husband and wife had filed for a divorce and attended a hearing where the wife testified the marriage was irretrievably broken. The parties had not obtained a legal separation and the divorce decree had not yet been entered.  

As a result the Arizona court viewed the ticket as community property and thus the wife received a portion of the prize. In Arizona, the marriage is not considered ceased until a final dissolution is entered by the court. Couples in Arizona, like the Rossis, who wish to end accumulation of community property, have the option to file for a legal separation. Denise Rossi had the option of obtaining a legal separation when she no longer acted or intended to be married to her husband. The existence of that right combined with her failure to exercise it, further persuaded the court to find in her husband’s favor and award him the prize money. 

Other jurisdictions use the date of separation as the date of cessation for accumulation of marital property. Therefore, lottery winnings from a ticket purchased during separation become the separate property of the spouse who purchased the ticket. Courts are not in agreement with this theory in cases where the property would normally be considered marital since the parties were still in a valid marriage.  

Compare the facts in Lynch with Alston v. Alston, where the husband appealed from a judgment awarding the wife one half of his lottery winnings when the couple had been separated for 1 1/2 years and the wife withdrew an initial divorce petition after learning of her husband’s stroke of luck. Neither husband nor wife had taken action toward dissolution proceedings prior to winning the Powerball. The wife urged the court to consider the parties’ continuous relationship after the separation and the significant efforts of the wife in the household responsibilities. The husband argued that the wife had not made any significant  contributions to the family and that the wife had abandoned the marriage, both factors considered under Maryland law. The husband further argued that one of the statutory factors, which allows the court to consider how and when the property was acquired, should prevent a monetary award. Finally, the husband pointed to the “catch-all” factor, under which the judge may consider other necessary or appropriate elements. He argued that the situation before the court was unique, in that the asset was not acquired through the parties’ joint efforts to provide for their future together.”  

The Court of Appeals ultimately sided with the husband and reversed the decision stating that property acquired after separation should be taken out of the marital property pool, noting that the timing of acquisition must be considered.  

The ultimate decision of whether to grant a monetary award and the amount of such an award are matters entrusted to the sound discretion of the trial court. Maryland distinguishes between an equitable division of property and an equal division of property.  

The Maryland Legislature specifically rejected the notion that marital property should presumptively be divided equally.

By definition, “personal injury law” is that area of the law designed to protect you --- your body, mind and emotions --- because of somebody else’s act or failure to act.  It is also known as “tort law.”  In a successful personal injury or tort action, the person who caused the injury or harm is called upon to compensate the person who suffered the losses.  Generally, there are three established theories of personal injury or tort liability:  negligence, strict liability and intentional misconduct.
The most common typical kinds of personal injury claims include traffic accidents, so-called “slip and falls”, tripping accidents, accidents at work, assault and battery claims, accidents in the home, product defects or so-called product liability claims, inter alia.  On a broader scale, “personal injury” can also include medical malpractice, dental malpractice, orthopedic (chiropractic) malpractice, and the category of industrial disease cases which encompass asbestosis and mesothelioma, emphysema, pneumoconiosis, silicosis, chronic bronchitis, asthma, chronic obstructive pulmonary disease and chronic obstructive airways disease, vibration white finger, occupational deafness, occupational stress, contact dermatitis, sarcodosis, post-traumatic stress syndrome (PTSS), and repetitive strain injury [“Nolo’s Free Dictionary of Law Terms and Legal Definitions”, Nolo.com, September 18, 2009; Black’s Law Dictionary; Barron’s Law Dictionary].
My main tip for the reader in this chapter on personal injury is that too many consumers who are victims of personal injury settle their cases too soon; without full and proper medical treatment and physical rehabilitation.
