MINIMIZING LEAD PAINT LIABILITY IN BALTIMORE : A PRIMER by ATTORNEY CHARLES JEROME WARE

For residential rental landlords in certain areas of Baltimore, lead paint claims are virtually epidemic. There are essentially two key reasons for this problem : (1) the large number of pre-1978 built houses and apartments ( which included lead paint when constructed) and (2) the substantial use of lead (Pb) for industrial purposes in Baltimore's history.

There are certain fundamental tips I advise my residential landlord clients in Baltimore and other major Northeast metropolitan areas of the United States.  A few of them are as follows:

1. Before purchasing the residential property, do a thorough background investigation  of it;
particularly if the property was built prior to 1978. Try to avoid purchasing properties with known lead and other environmental hazards.

2. Engage in  lawful and due-diligent background checks of potential tenants, including credit reports, references, criminal background checks etc.

3. Be diligent in repair and maintenance of the rental property; particularly with respect to environmental hazards such as lead (Pb) paint, asbestos, mold, etc.

4. Use qualified and government-certified workers ( Maryland Department of the Environment, or MDE; and U.S. Environmental Protection Agency, or EPA) for all lead, asbestos and mold-abatement work.

5. Provide lawful and proper notice to tenants of and both potential and actual lead paint and other environmental hazards [ and see, TITLE X(10), etc.].

6. Seek and acquire adequate lead and other environmental hazard liability insurance, and other appropriate rental insurance.

7. Acquire lead-free certifications from the government for your rental properties.

8. Keep good tenant and rental property records.

For the average residential rental landlord, Baltimore is considered by some commentators to be "ground zero" for resident complaints and claims such as lead paint and lead poisoning. asbestos issues, mold and radon problems, as well as housing discrimination lawsuits. One of the reasons for this is the large number of apartments and houses in certain neighborhoods that were built before 1978 (when lead paint was outlawed in these residential units).  A second reason is the previous history of heavy industrial use of lead (Pb), asbestos, and other chemicals and compounds in the metropolitan area, etc.,

Baltimore residential landlords must be careful to stay on top repair and maintenance needs for their properties
and make necessary repairs on the property promptly when reported.

Further, landlords should not fail to disclose and remedy environmental hazards such as lead paint and other lead poisoning, mold, asbestos and radon.

Although landlords are encouraged to engage in due diligence when checking the backgrounds of prospective tenants, and in maintaining tenant and property files, care must be taken to avoid discrimination against tenants.

We strongly recommend that landlords seek adequate liability and other types of property insurance.

Finally, hire qualified managers to run your rental properties, and hire Maryland Department of the Environment (MDE) - certified workers to perform any and all lead abatement, asbestos abatement, etc., work on the rental properties.

A security clearance essentially declares that a person is trusted to safeguard national security information. There are various levels of security clearance, all of which require different levels of investigation. Top secret clearance is the highest level a person can obtain. The second highest level is secret clearance. The third level of security clearance is confidential clearance. each level of clearance requires an investigation into a person's background for a defined period of time, usually the last 10 years or so. Persons seeking to obtain the security clearance must provide the necessary detailed, personal information to complete the thorough investigation


Even after a person obtains a security clearance, it does not mean they have it for good. Each level requires reinvestigation at different times. Holders of top secret clearances require reinvestigation every 5 years. Those persons with secret clearances must undergo reinvestigation every 10 years. Confidential clearance employees need to be reinvestigated every 15 years.
