Maryland  DUI :  means " driving under the influence " of alcohol. This criminal/traffic charge is reserved for drivers with a BAC (Blood Alcohol Concentration) of 0.08 % or higher.  Conviction can result in penalties such as a one-year  jail sentence and up to $ 1,000 in fines.

Maryland  DWI :  means "driving while impaired " with alcohol. This criminal /traffic charge can be brought against a driver with  a BAC of  0.07%.  Conviction can result in penalties up to two months in jail and a$500 fine.

Under Maryland law , the driver is subject to the automatic suspension of his or her license for 60 days when charged with a DUI and 45 days when charged with a DWI.  You must request an administrative hearing within 10 days of your arrest or your driver's license privileges will be suspended automatically by the Motor  Vehicle  Administration (MVA).

The 10-Year Period :  In Maryland a judge can look back at your court record for the past 10 years.  If you had a DUI or DWI offense within that 10-year period you are NOT eligible to be considered a "first offender".  This is important because most "first offenders" with low BACs can usually get probation.
