MARYLAND DUI DILEMMA FOR FEMALES : THE "GENDER FACTOR" BIAS

 Premise:  When it comes to DUI and DWI enforcement, females are discriminated against.
 Standardized field sobriety tests (SFSTs),  breath tests (Breathalyzers), blood tests and urine tests that are used by law enforcement to arrest and prosecute DUI and DWI suspects all discriminate against females.

Males and females absorb alcohol differently, since their bodies are physiologically different.
Generally, females have less water in their bodies and more adipose tissue, or fat.  According to many experts in DUI cases, these tests tend to routinely score women artificially high in alcohol because they simply do not adequately take into account the differences in physiology between males and females; i.e, the "gender factor". Females metabolize alcohol differently [more slowly] than males.

DUI breath testing devices are biased against females because they are calibrated allegedly to a male's physiological make-up and not a female's physiological make-up. Further, so-called standardized field sobriety tests are not designed for females and, consequently, are more difficult for females to perform. This causes females to appear more intoxicated than men simply because females are not suitable candidates for the current field sobriety testing done by law enforcement agencies in Maryland and across the country.

Despite general and common public beliefs, there are several defense tips and strategies that are typically relevant in defending drunk driving cases, depending upon the facts of the case. Not all of these scenarios apply, but adjustments and refinement of these defenses can occur during proper investigation of  each case.

Having successfully represented hundreds of satisfied DUI and DWI clients during a period of over 30 years, I have learned that DUI and DWI cases do not rest on the "hard science" that law enforcement allege they do. Instead, they rest on erroneous and misguided confidence building --- virtually "snake oil salesmanship."  As a result, hundreds of innocent drivers are convicted of DUI and DWI every day in our courts; frequently by pleading guilty to these charges even when the prosecution's evidence is insufficient or highly questionable. Do your best to NOT be one of these victims.

A few DUI and DWI defense argument tips: 

(1) The police officer lacked "probable cause" for the DUI arrest.
(2) "Weaving" within your driving lane does not justify a DUI or DWI stop.
(3) "Alcohol" on your breath does not automatically mean the drive is "under the influence" of alcohol.
(4)  Suffering from GastroEsophageal Reflux Disease (GERD), acid reflux or heartburn can caused a falsely high reading on the DUI Breath Alcohol Test.
(5) The police officer lacked justification to make the DUI traffic stop .
(6) The Standardized Field Sobriety Test ("STFTs") were not administered properly.
(7) The Non-Standardized Field Sobriety Tests lack.
 reliability.
(8) Field Sobriety Tests provide a poor measure of DUI and DWI Impairment.
(9) Mouth alcohol can contaminate the breath alcohol rest results.
(10) The Breath Alcohol Test yields unduly high results during absorption.
(11) Police officers have no unique or special ability to judge intoxication levels.
(12) No sign of mental impairment of the driver.
(13) Innocent explanations for the symptoms of intoxication.
(14) Speeding (and most other driving violations) are not automatically correlated with DUIs and DWIs.
(15) Breath Testing Machines can mistake other chemicals for alcohol.
(16) Low-carb diets can cause falsely high DUI breath test readings.;  among others.

The jurisdiction of the District Court of Maryland includes:
(1) All landlord-tenant cases;
(2) Replevin actions;
(3) Motor vehicles violations, misdemeanors and certain felonies;
(4) In civil cases the court has exclusive jurisdiction in claims for $5000.00 or less, and concurrent jurisdiction with the circuit courts in claims for amounts above $5000.00 but less than $30,000.00.
(5)The jurisdiction of the District Court is concurrent with that of the circuit court in criminal cases classified as misdemeanors and certain felonies, in which the penalty may be confinement for 3 years or more or a fine of $2500.00 or more.
(6) The District Court does not conduct jury trials.

 The following are five(5) tips to help ensure you have the right expectations to make your divorce as successful as possible :

(1) In reality, divorces can be traumatic for everyone involved - regardless of personality, training, or even mindset.. Do not underestimate  this fact. Take this process seriously. We do for our clients.
(2) In over 30 years of successful legal representation for highly-satisfied clients in divorces, I have come to believe that parties to a divorce should realistically expect to "survive" this difficult process --- not necessarily "win". One's attitude is very important.
(3) "Measure twice, cut once." Do not make important decisions in your divorce without thinking them through and consulting with your attorney. Though difficult  --- try to think rationally, not emotionally.
(4) REMEMBER : You and your spouse are the ones getting divorced;  not your children.
(5) Do not believe everything other lay- people tell you about your divorce - or their divorce - or about anybody else's divorce; and certainly question the divorce views of someone who has never been divorced previously. Consult with your attorney as well as with other experts on the subject.

The closest thing Maryland provides to a "legal separation" is the "limited divorce".

In Maryland, the court may grant a decree for a LIMITED DIVORCE ( aka, " LEGAL SEPARATION")  on the following grounds:
(1) Cruelty of treatment of the complaining party or to a minor child of the complaining party;
(2) Excessively vicious conduct to the complaining party or to a minor child of the complaining party;
(3) Desertion; or
(4)Voluntary separation, if:
     (I) the parties are living separate and apart without cohabitation; and
(ii) there is no reasonable expectation of reconciliation.

An "annulment" differs conceptually from a divorce in Maryland in that a divorce terminates
a legal marital status, whereas an annulment establishes that a marital status never existed.

Annulments are extremely rare in Maryland.

The rule in Maryland has long been that a marriage procured through fraud may be avoided in the exercise of the inherent power of a court of equity to reform and rescind contracts. This inherent power refers to the authority of a court to grant an annulment separate and apart from any statute authorizing the granting of a divorce or annulment. Just what facts and circumstances will cause a marriage to be declared void is a question that has concerned our courts for many years.

Some of the rare occasions in which an equity court in Maryland may grant an annulment include the following:
(1) Either party being married to someone else at the same time;
(2) If the marriage is between closely-related persons. In Maryland, a person may not marry his or her parent, step-parent, grandparent, step-grandparent, child, step-child, grandchild, step-grandchild, sibling, step-sibling, aunt, uncle, niece or nephew. A person also may not marry his or her spouse's close relatives.
(3) If either party was legally insane or could be considered incompetent to enter a marriage contract.
(4) A party being underage as defined by being:
- Under the age of 15;
- Under the age of 16 without a parent or guardian's consent along with proof of a current pregnancy or birth; or
- Between the ages of 16 and 17, and not having either the proper parental consent or proof of a current pregnancy or birth.
(5) The inability to consummate the marriage.
(6) The marriage was based on fraud or entered into under duress.
(7) Either party did not understand what they were consenting to.
(8) The marriage ceremony was performed by someone without the legal authority to do so.

The dreaded SUMMONS, with the accompanying COMPLAINT. YOU ARE BEING SUED.
One of the biggest and most serious mistakes people make after being served in a lead(Pb) paint case
is their failure to respond within the proper time-period to answer it and the complaint (usually within 30 days), and consequently they DEFAULT. This makes it a lot easier for the plaintiff to collect money from the defendant, regardless of fault. When you are sued, call us immediately for a courtesy consultation. The SUMMONS from the Circuit Court is a two-page document which mandates (orders) a written response to the attached COMPLAINT within a certain period of time to be filed with the Clerk of the court ( and that a copy be sent to the opposing party/person). Failure to respond properly in a timely manner can cause you to be held in DEFAULT. YOU DO NOT WANT A DEFAULT.


Once you receive a summons and accompanying complaint, you should consult with an attorney IMMEDIATELY.
