QUESTION: Are there any exceptions or exemptions to the Federal Lead Disclosure Rule (of 1996) ?
ANSWER: Yes.


The Federal Lead Disclosure Rule of 1996 is a right-to-know law that requires notification and disclosure to tenants and home purchasers  by landlords and sellers of certain lead-based paint information.


If the residential unit (apartment or house) being leased or purchased is a zero bedroom dwelling, or if it is housing for the elderly (and no children under the age of 6 reside there), or if the unit has been certified as "lead-based paint free" by a certifies lead-based paint inspector or risk assessor, then the Lead Disclosure Rule does not apply.
