All federal and state codes prohibit the possession of certain drugs whether it is marijuana, methamphetamine, or even the unlawful possession of prescription medication.
Maryland has decriminalized the possession of marijuana to an extent, making possession of small amounts (less than 10 grams) a civil offense --- subject to a fine ---, similar to a moving vehicle violation. Possession of other drugs can lead to severe penalties, depending upon the amounts possessed and whether intent to distribute is established.
Maryland penalties by drug type and amount :
(1) Possession of all controlled substances (not marijuana) such as herion, cocaine and methamphetamine is considered a misdemeanor with maximum penalties of up to 4 years, and/or $25,000. Transporting 28 grams or more into the state is a felony with penalties of up to $50,000 and/or 25 years. Subsequent offenses double the penalties.
(2) Marijuana possession of less than 10 grams is a civil citation offense with a maximum penalty fine of $100.
Marijuana possession of 10 grams to less than 50 lb. is a misdemeanor with penalties up to one year in jail and a fine up to $1,000.
Marijuana possession over 50 lbs. is a felony with penalties up to 5 years imprisonment and fines up to $100,000.
