Baltimore is not the only geographic area in Maryland that has toxic lead paint issues. Any jurisdiction in Maryland that contains pre-1978 built rental houses and apartments --- including upscale Montgomery County --- is also subject to lead paint poisoning claims and lawsuits. Lead is virtually everywhere in Maryland in residential and industrial areas developed prior to the Federal banning of lead paint for consumer uses in 1978 : in the air, in the water, in housing, as well as in numerous consumer products manufactured or produced outside of the United States.
.For all landowners and landlords for pre-1978 built rental houses and apartments, development of the lead paint poisoning defense begins when the property is purchased. Good initial and continuing maintenance of the rental property, adequate law-satisfying notice to the tenants, and good record-keeping/documentation are paramount to successful avoidance of, and prevailing in, lead paint poisoning claims and lawsuits.
At a minimum, the following are documents for the landlord to maintain for each tenant and each pre-1978 built rental property:
1. Tenant file.
2.Records of tenant complaints.
3. Property repair records.
4.Maintenence records (including painting and sheetrocking,etc.).
5. Names of all vendors (workers, etc.)
6.Names of any entities retained to insure compliance with federal, state and/or local laws.
7. Names of persons responsible for repair and maintenance of the.rental units.
8. Lead abatement records.
9. Other documents.
