However, it is scientifically established that no measurement is absolutely perfect. That fact is particularly true with DUI breathalyzer devices.

The first thing I recommend a landlord should do when sued for lead paint poisoning is to immediately
find out if they have or had liability insurance coverage for the situation. As simple as this step may seem, like everything else associated with lead poisoning claims it is not simple.
While insurance companies routinely provided liability coverage for lead poisoning claims in the 1970s, 1980s, and part of the 1990s, thereafter coverage became much more difficult and expensive. In fact, in many situations today insurance companies routinely exclude coverage for lead paint.
Important factors to find out in determining whether your insurance covered the claim are (i) to find out whether the child lived on the property (if possible); then, if so, (ii) when the child lived on the property (if possible); (iii) what was the age of the child at the time (allegedly); and (iv) when the child had elevated lead levels (if at all). In any event, CONTACT YOUR INSURANCE COMPANY IMMEDIATELY TO DETERMINE IF YOU ARE COVERED FOR THE CLAIM.

In 1978, the U. S. Consumer Product Safety Commission (CPSC) enacted Federal legislation that banned toxic lead-based paint in consumer products. Lead paint, according to sources, however, can still be found in more than 24 million houses and apartment buildings. Presumably, these houses and apartment buildings were constructed and lead painted before 1978.
Prior to renting the residential unit, the landlord must by law submit a written disclosure to prospective tenants detailing any known lead-cased paint on the property. The landlord is also required to provide a pamphlet from the Federal government on lead poisoning prevention. The lease agreement must contain legally appropriate wording that warns of the presence of lead-based paint. If the property was built after 1978, the law does not require landlords to test for presence of lead-based paint.
If landlords want to renovate rental properties built before 1978, there are certain laws they must
follow. In 2010, Federal legislation known as the Renovation, Repair and Painting Rule, was enacted. Backed by the U. S. Environmental Protection Agency (EPA), it requires renovators to receive mandatory licensing in lead-based paint removal (lead abatement). In Maryland, for example, all lead abatement and similarly-situated workers and contractors must be certified by the Maryland Department of the Environment (MDE).
Landlords can face significant legal penalties if they fail to disclose the presence of lead-based in rental properties in many jurisdictions. It is required that landlords distribute the important EPA tenant lead notice pamphlet as well as use lawfully lead-certified workers on teir rental properties.

Lead paint laws are prolific at local, state and federal levels throughout the United States. Residential rental landlords should be cognizant of these laws in their geographic areas of rental business.
Lead-based paint is cited by many health-related agencies as one of the top environmental threats to children in the United States. Abnormally high levels of lead (Pb) can cause damage to the nervous system and cause other health problems, particularly in very young and developing children under the age of six. To compound the problem, lead is virtually everywhere in many urban residential communities such as Baltimore, Newark, Philadelphia, New York and Boston.
There are 3 general lead claim-prevention tips I recommend that landlords should follow when renting residential
units: (1) diligently MAINTAIN the rental properties; (2) provide lawful NOTICE to all tenants in the rental properties; and (3) keep good RECORDS (tenant and property files) on both the tenants and the properties for at least 21 years.

Toxic lead in inner-city Baltimore soils poses health hazards for the human body; particularly for children up to age 6 who inhale or ingest these affected soils.
This conclusion came from a group of researchers who took soil samples which were randomly collected from 422 vegetable gardens in a study area centered in downtown Baltimore, Maryland. The radius of the study area was 48.28 kilometers (30 miles). The levels of lead (Pb), 4 other metals (cadmium, copper, nickel and zinc), and pH (acidity and alkalinity) were measured for each location. The levels of lead in the soil in inner-city Baltimore registered higher on a consistent basis than levels in outlying Baltimore communities.
