The drunk driving ( or "DUI") breathalyzer is based on measuring breath alcohol of a driver.
However, it is scientifically established that no measurement is absolutely perfect. That fact is particularly true with DUI breathalyzer devices.


Whether measuring breath alcohol or a length of wood, variation in measurement is always present
[ Estimating the measurement uncertainty in forensic breath-alcohol analysis",  Accred. Qual. Assur., 11: 562 - 568 ].  Unavoidable fluctuations in process result in minute variations in measurements.


This does not mean that every DUI breathalyzer measurement is flawed or unreliable. However, this does prevent DUI defense counsel from attempting to amplify legitimately this genuine measurement uncertainty into reasonable doubt in drunk driving cases involving alcohol breath test devices or even blood tests.
