Divorce can be traumatic, no matter who you are. It can be particularly stressful for children. However, divorce is frequently necessary for people to move forward with their lives in a more positive manner. In my view, from over 30 years of successful representation of parties in divorce actions in Maryland and other states, the basic end-goal of divorce is "survival", not necessarily "winning." In surviving a divorce you win.
Divorce in Maryland can be "contested", which requires adversarial proof, or they can be "uncontested", which are usually based upon a mutual and voluntary separation of at least one year.
Grounds for divorce in Maryland can include at least one year or at least two years' separation (living separate and apart without interruption); adultery; abandonment or desertion; conviction of a felony or a misdemeanor (requiring incarceration for one year under a sentence of three or more years); insanity; cruelty; excessively vicious conduct; etc.
Defenses against divorce in Maryland can include, in some instances, insanity of the accused violator, condonation and recrimination ( solely as mitigating factors to be decided by a judge).
Legal separation in Maryland can come in the form of a "limited divorce"; provided, of course. grounds are established, including: cruelty of treatment, excessively vicious conduct, desertion and voluntary separation.
Annulments in Maryland are granted by the court only in certain rare cases. The legal effect is to void a marriage from the very beginning --- as if the parties had never married.
In Maryland, prior to filing your petition or complaint for divorce, you must have resided in the state for at least one year. However - -- emergency, child custody or other matters may be filed in Maryland without regard to this one-year requirement.

In over 30 years of successful legal representation of parties in divorce actions in Howard County and elsewhere in Maryland, I have never handled a case that was not traumatic for them --- regardless of whether they articulated their distress or not. The fact is that when a marriage comes to an end, spouses and their children frequently face tremendous stress and emotional conflict. Many things suddenly become new in their lives, including: new living arrangements, new parenting schedules and demands, decisions about marital property and money, etc. Understandably, all of the above can make it difficult for even the calmest person make sound decisions and understand fully the necessary legal process involved in getting the divorce.
Engaging rational and experienced attorneys on both sides in the divorce can obviously be extremely helpful in surviving this difficult and traumatic process. Being better informed in advance about the process can also help:
(1) There are no "winners" in a divorce, only victims and survivors. Therefore, do not enter into a divorce expecting to "win". Enter expecting to "survive" this traumatic experience, and have a better life afterwards. Good lawyering helps in this effort.
(2) Do not make important decisions without consulting an attorney, and thinking the issue through thoroughly. As I advise all of my clients: "measure twice, cut once" when making these decisions.
(3) Always remember: YOU are getting the divorce, NOT your children. Think about that a moment.
(4) Every divorce is unique; no two divorces are the same. Therefore, do not believe everything other people tell you about their divorce or what they heard about someone else's divorce.
(5) Divorce is principally about the future, not the past. When you enter into a divorce, focus primarily on your (and your children's ) future; despite how awful the past may have been.

Divorce is already a traumatic experience for most individuals and their families. Dealing with a toxic spouse who is vengeful or angry for whatever reason, or lack thereof, can make the touchy divorce process even more difficult by dragging out issues that normally could be resolved with better cooperation and compromise, and with mutual agreements outside of the courtroom. With reasonableness and serious-mindedness, for example, voluntary mediation between the parties can be extremely helpful.
For both parties in a difficult divorce, I recommend the following, inter alia:
(1) DOCUMENTATION, DOCUMENTATION, DOCUMENTATION. There is no substitute for documentation of a party's position in a difficult divorce. Frequently, one or both parties may mis-state or even fabricate their positions to get what they want out of the divorce. documentation rules.
(2) KEEP THE UNFORTUNATE PAST IN THE PAST. And try very hard to focus on the present and future situations. The parties cannot undue the past, but they can at least work to salvage what remains of their individual futures ( as well as the futures of their innocent children, if any).
(3) SEEK THERAPY If YOU FEEL TRAUMATIZED. As stated previously, divorce is generally traumatic for most people. Seek professional help to cope.
(4) Of course, GET AN ATTORNEY TO REPRESENT YOU. This goes without saying. And, be very honest with your attorney.
(5) However, your goal in getting your attorney to represent you in your divorce is not necessarily to "win" the divorce [ whatever that is], but to maximize your opportunities for a fair and just result for you in the divorce. It is my observation that there are rarely any " winners" in divorce; mainly victims.
(6) EMOTION KILLS; THOUGHT HEALS. Do not make important decisions in a divorce without careful thought and consultation with your attorney.

Divorce is already a traumatic experience for most individuals and their families. (3) SEEK THERAPY If YOU FEEL TRAUMATIZED. As stated previously, divorce is generally traumatic for most people. Seek professional help to cope.

(5) However, your goal in getting your attorney to represent you in your divorce is not necessarily to "win" the divorce [ whatever that is], but to maximize your opportunities for a fair and just result for you in the divorce. The Residential Lead-Based paint Hazard Reduction Act of 1992, commonly known as TITLE X, was passed in an attempt to reduce the number of lead poisoning (Plumbism) victims in the United States. TITLE X, is a Federal law and is enforced by the U.S. Environmental Protection Agency (EPA) and it enforces regulations related principally to residential rental property buildings that were constructed before 1978.
Following up on TITLE X is the Federal law known as the Real Estate Notification Rule of 1996 ( also referred to as the "Lead Disclosure Rule"). This law is essentially a right-to-know rule that requires notification and disclosure of certain lead-based paint information. It took effect on September 6, 1996 ( for sellers and lessors of five or more residential dwelling units) and on December 6, 1996 (for sellers or lessors of one to four residential dwelling units). It, too, deals primarily with residential units (houses and apartments) that were built before 1978.
Since Federal law banned the residential and general consumer use of lead-based paint in late 1977, housing generally containing lead paint was necessarily constructed prior to 1978.
Essentially, ingested and/or inhaled lead in sufficient quantity can be harmful to the human body. Therefore --- chipped or peeled or cracked lead paint, or lead dust, etc., which is ingested or inhaled may cause serious harm to humans. DISCLOSURE and NOTICE, MAINTENANCE and RECORD-KEEPING concerning lead-based paint is critical.

For quite a while now, lead poisoning (Plumbism) has been a public health problem in Baltimore and elsewhere in major cities in the United States. Lead (Pb) in Baltimore and other industrial cities comes from a number of sources including, inter alia, drinking water, plumbing, soil, dust, the air we breathe, some foods , toys, ceramics, pottery, work places, jewelry, etc., and lead-based paint.
In 1977, the Federal government banned the residential use of lead paint both inside and outside of residences in the United States. Therefore, the primary concern over residential lead-based paint comes from residences (houses and apartments) built before 1978. Landlords must be aware of the date their rental property was built, and be prepared to properly maintain the property as " lead-free" as humanly possible.
It should be understood that "uninterrupted" lead paint, alone, is not hazardous to the human body. It "interrupted" lead paint that can be harmful to the body when ingested and/or inhaled: that is, lead paint that is chipped, cracked, in dust form, peeled, etc. Any lead abatement work performed on these properties should be done by Maryland Department of the Environment- lead certified workers. Maintenance, Notice to tenants, and Record-keeping are key for any landlord renting pre-1978 built residential units in Baltimore.
