"WHISTLEBLOWERS: UPDATE", by Attorney Charles Jerome Ware, author of the best-selling book, UNDERSTANDING THE LAW: A Primer (iUniverse Publishers, 2008)

The Securities and Exchange Commission (SEC) lawyer who has very publicly accused the SEC of improperly destroying thousands of sensitive investigation documents of targeted companies and corporate officials was also successful in a previous whistleblower action in Michigan.  In that 1993 Michigan medicare fraud case, Darcy Flynn was awarded about $2.7 million as a whistleblower.  Michigan has its own whistleblower law.

In his current whistleblower action against the SEC, Mr. Flynn's complaint comes under the Federal Whistleblower Protection Act of 1989 which is designed to protect Federal employee whistleblowers who work for the Government and report Agency misconduct.  Mr. Flynn could, again, receive compensation from the Government for his SEC whistleblower actions.
