For residential rental landlords in certain areas of Baltimore, lead paint claims are virtually epidemic. There are essentially two key reasons for this problem : (1) the large number of pre-1978 built houses and apartments ( which included lead paint when constructed) and (2) the substantial use of lead (Pb) for industrial purposes in Baltimore's history.
There are certain fundamental tips I advise my residential landlord clients in Baltimore and other major Northeast metropolitan areas of the United States. A few of them are as follows:
1. Before purchasing the residential property, do a thorough background investigation of it;
particularly if the property was built prior to 1978. Try to avoid purchasing properties with known lead and other environmental hazards.
2. Engage in lawful and due-diligent background checks of potential tenants, including credit reports, references, criminal background checks etc.
3. Be diligent in repair and maintenance of the rental property; particularly with respect to environmental hazards such as lead (Pb) paint, asbestos, mold, etc.
4. Use qualified and government-certified workers ( Maryland Department of the Environment, or MDE; and U.S. Environmental Protection Agency, or EPA) for all lead, asbestos and mold-abatement work.
5. Provide lawful and proper notice to tenants of and both potential and actual lead paint and other environmental hazards [ and see, TITLE X(10), etc.].
6. Seek and acquire adequate lead and other environmental hazard liability insurance, and other appropriate rental insurance.
7. Acquire lead-free certifications from the government for your rental properties.
8. Keep good tenant and rental property records.

In general, civility is a goal in the judicial systems of Howard County and Montgomery County, Maryland. Therefore, a party's behavior during the very stressful and traumatic event of divorce is
observed carefully. It is my observation in over 30 years of representing good people in divorce and family law matters that, regardless of the attitude the party presents superficially, everyone is adversely affected emotionally, psychologically, and financially by their divorce. I have always tried very hard to be cognizant of and sympathetic with this fact. Divorce is tough on a person, and especially on children of the parties. Divorce and family law involves the raw emotions of human beings, not mechanical widgets. Nobody "wins" in a divorce, but it is still possible to have a
"successful " divorce. A summary guide ( "WARE's GUIDE") I recommend is as follows:
1. Do not enter into a divorce with an attitude to "win". The better attitude for a party, I have observed, is to enter the divorce process with an attitude of "successful survival" of this stressful process. This attitude actually increases your chances of "winning"( whatever that standard means to you.).
2. Just as you preferably did before you married your spouse, measure at least twice (consider carefully your decision) before you decide to pursue a divorce from your spouse. Be absolutely sure the divorce is what you want to do.
3. Get good, sound and reasonable divorce legal advice early in the process. But the final decision to act must be your decision, not that of anyone else.
4. If you it may help, seek competent therapy to discuss your situation.; particularly when their are children involved.
5. Speaking of children, remember it is not the children that are getting the divorce from the other parent; it is the parents who are getting the divorce from each other. The children are, quite frankly, victims of the divorce.
6. EDUCATE yourself on the divorce process. Your divorce can be helpful with this.
7. Set reasonable goals and make reasonable plans for the future.
8. Collect copies of all of your financial records and documents immediately.
9. Keep your children uupermost in mind duiring your divorce
10. Create and maintain the "big picture" of your divorce and your future.

Interior house lead-based paint was banned by Congress in 1970 but it was still available in the marketplace until it was banned by the Federal government in 1978. This soft, malleable, useful, utilitarian, physically harmful (when inhaled or ingested), and heavy metal (Atomic Number 82) has a scientific "half-life" of over 500,000 years, does not dissolve in water, nor decay, nor dissipate, nor burn. Lead just lasts, and lasts, and lasts. Lead is believed to have first been mined and used by societies and civilizations as early as 4,000 B.C. --- over 6,000 years ago. Its use has been prolific since then. Scientists and other researchers estimate there are billions of pounds and multi-millions of metric tons of lead currently
in the earth's environment.

The drunk driving ( or "DUI") breathalyzer is based on measuring breath alcohol of a driver.
However, it is scientifically established that no measurement is absolutely perfect. That fact is particularly true with DUI breathalyzer devices.

The first thing I recommend a landlord should do when sued for lead paint poisoning is to immediately
find out if they have or had liability insurance coverage for the situation. As simple as this step may seem, like everything else associated with lead poisoning claims it is not simple.
While insurance companies routinely provided liability coverage for lead poisoning claims in the 1970s, 1980s, and part of the 1990s, thereafter coverage became much more difficult and expensive. In fact, in many situations today insurance companies routinely exclude coverage for lead paint.
Important factors to find out in determining whether your insurance covered the claim are (i) to find out whether the child lived on the property (if possible); then, if so, (ii) when the child lived on the property (if possible); (iii) what was the age of the child at the time (allegedly); and (iv) when the child had elevated lead levels (if at all). In 1978, the U. S. Consumer Product Safety Commission (CPSC) enacted Federal legislation that banned toxic lead-based paint in consumer products. Lead paint, according to sources, however, can still be found in more than 24 million houses and apartment buildings. Presumably, these houses and apartment buildings were constructed and lead painted before 1978.
Prior to renting the residential unit, the landlord must by law submit a written disclosure to prospective tenants detailing any known lead-cased paint on the property. The landlord is also required to provide a pamphlet from the Federal government on lead poisoning prevention. The lease agreement must contain legally appropriate wording that warns of the presence of lead-based paint. If the property was built after 1978, the law does not require landlords to test for presence of lead-based paint.
If landlords want to renovate rental properties built before 1978, there are certain laws they must
follow. In 2010, Federal legislation known as the Renovation, Repair and Painting Rule, was enacted. Backed by the U. S. Environmental Protection Agency (EPA), it requires renovators to receive mandatory licensing in lead-based paint removal (lead abatement). In Maryland, for example, all lead abatement and similarly-situated workers and contractors must be certified by the Maryland Department of the Environment (MDE).
Landlords can face significant legal penalties if they fail to disclose the presence of lead-based in rental properties in many jurisdictions. Lead paint laws are prolific at local, state and federal levels throughout the United States. Residential rental landlords should be cognizant of these laws in their geographic areas of rental business.
Lead-based paint is cited by many health-related agencies as one of the top environmental threats to children in the United States. Abnormally high levels of lead (Pb) can cause damage to the nervous system and cause other health problems, particularly in very young and developing children under the age of six. To compound the problem, lead is virtually everywhere in many urban residential communities such as Baltimore, Newark, Philadelphia, New York and Boston.
There are 3 general lead claim-prevention tips I recommend that landlords should follow when renting residential
units: (1) diligently MAINTAIN the rental properties; (2) provide lawful NOTICE to all tenants in the rental properties; and (3) keep good RECORDS (tenant and property files) on both the tenants and the properties for at least 21 years.
Recognizing the health problems caused by lead poisoning, the Federal Residential Lead-Based Paint Hazard Reduction Act, commonly known as TITLE X (Title 10) was enacted in 1992. The law directed the U. S. Environmental Protection Agency (EPA) as well as the U. S. Department of Housing and Urban (HUD) to write regulations specifying how Title 10's goal of lead hazard reduction should be accomplished. The regulations apply to rental property built before 1978.
The regulations specify, inter alia, that, prior to signing a lease or rental agreement, the landlord must give every new tenant the EPA pamphlet, Protect Your Family From Lead In your Home. Both the landlord and the tenant must sign an EPA-approved form, Disclosure on Lead-Based Paint and/or Lead-Based Paint Hazards, that will prove that the landlord informed the tenents about any known lead-based paint or lead-based paint hazards. The landlord must keep the executed disclosure form as part of his or her records (tenant file, etc.) for at least 3 years from the date of the start of the tenancy.

The levels of lead (Pb), 4 other metals (cadmium, copper, nickel and zinc), and pH (acidity and alkalinity) were measured for each location. The levels of lead in the soil in inner-city Baltimore registered higher on a consistent basis than levels in outlying Baltimore communities.

The Baltimore Sun newspaper recently featured a front page article on the continuing lead paint poisoning issues in the city, as well as new efforts by community groups, officials, etc., seeking reparations, restitution, damages, etc., from major lead paint manufacturers whose lead-based paint was sold and used in Baltimore housing prior to being banned by Baltimore in 1951 and 1966, as well as by the Federal government in 1978 [ " SEEKING PAYBACK", by Luke Broadwater, Sunday Edition, February 28, 2016 ].
The article is worth the read, particularly since it indicates what some of us have been saying for years: that the lead poisoning problem is larger than just slumlords, negligent renters, and lazy government officials. At its lead paint source, a huge problem comes from big-money making paint manufacturers who aggressively sold toxic lead-based paint long after they knew or should have known of the harmful effects of the product when inhaled or ingested by humans; and in particular, by children under the age of six.
